idea of “Intersectionality,” holds that the
classical categories of oppression (race,
gender, class, sexual orientation, etc.)
do not operate independently, but rather
intersect to create multiple, non-discrete
forms of discrimination. The law’s embrace
of discrimination claims, however, based
on “multiple protected categories” has
been partial and uneven and awkward to
apply (for example, when different bases
of discrimination have different statutes of
limitations and different burdens of proof).
